By accessing and using the 29 Travel Club website and services (the "Platform"), you agree to be bound by these Terms of Service. If you do not agree to abide by the above, please do not use this service. 29 Travel Club reserves the right to update and change these Terms of Service at any time without notice. Your continued use of the Platform following the posting of revised Terms of Service means that you accept and agree to the changes.
Permission is granted to temporarily download one copy of the materials (information or software) on 29 Travel Club's Platform for personal, non-commercial transitory viewing only. Further, 29 Travel Club does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on the Internet or relating to such materials or on any sites linked to this site.
In no event shall 29 Travel Club or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on 29 Travel Club's Platform, even if 29 Travel Club or an authorized representative has been notified orally or in writing of the possibility of such damage. These Terms of Service and any separate agreements we provide to render services to you are governed by and construed in accordance with the laws of the jurisdiction in which 29 Travel Club operates, without regard to its conflict of law provisions.
When you create an account on 29 Travel Club, you must provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account information and password and for restricting access to your computer. You agree to accept responsibility for all activities that occur under your account or password. You agree to notify 29 Travel Club immediately of any unauthorized use of your account or any other breach of security. 29 Travel Club will not be liable for any loss or damage arising from your failure to comply with this security obligation.
You retain all rights to any content you submit, post or display on or through the Platform ("User Content"). By submitting, posting or displaying User Content on or through the Platform, you grant 29 Travel Club a worldwide, non-exclusive, royalty-free license to use, copy, reproduce, process, adapt, modify, publish, transmit, display and distribute such content in any media or medium and for any purposes. You represent and warrant that you own or have the necessary rights to the User Content you submit and that such content does not violate the intellectual property rights of any third party.
You agree not to engage in any of the following prohibited conduct: • Harassing, threatening, intimidating, or abusing any member or staff of 29 Travel Club • Posting or transmitting offensive, obscene, or unlawful content • Impersonating any person or entity • Uploading viruses or malicious code • Collecting or tracking personal information of others without consent • Spam, phishing, or other fraudulent activities • Violating any applicable laws or regulations • Interfering with the operation of the Platform • Attempting to gain unauthorized access to the Platform • Reselling or redistributing Platform services • Creating multiple accounts to circumvent restrictions
Members who participate in home exchanges agree to: • Treat the host's home with respect and care • Follow all house rules provided by the host • Report any damage or issues immediately • Maintain the property in the condition it was received • Respect the privacy and property of the host • Not sublet or transfer the property to third parties • Comply with all local laws and regulations • Provide accurate information about themselves and their home 29 Travel Club is not responsible for disputes between members regarding property condition, damages, or other issues arising from home exchanges. Members are encouraged to document property conditions with photos before and after exchanges.
29 Travel Club may conduct background checks and verification procedures on members. By joining 29 Travel Club, you consent to these verification processes. Information obtained during verification will be used solely for the purpose of ensuring community safety and verifying member eligibility. Members must provide accurate identification and personal information. Providing false information may result in account termination and legal action.
All payments are processed through Stripe, a secure payment processor. By making a payment, you authorize 29 Travel Club to charge your payment method for the amount specified. Membership fees are non-refundable except as required by law. Refunds for booking disputes or other issues will be handled on a case-by-case basis in accordance with our Refund Policy. All prices are in USD unless otherwise specified. Additional taxes may apply depending on your location.
In the event of a dispute between members or between a member and 29 Travel Club, the parties agree to attempt to resolve the dispute through good faith negotiation. If negotiation fails, disputes may be submitted to binding arbitration in accordance with the rules of the American Arbitration Association. Each party shall bear its own costs and expenses, including attorney's fees. You agree to waive your right to a jury trial and class action lawsuit.
29 Travel Club reserves the right to terminate or suspend your account at any time, with or without cause, and with or without notice. Causes for termination include, but are not limited to: • Violation of these Terms of Service • Engaging in prohibited conduct • Providing false or misleading information • Harassing or abusing other members • Damaging property during exchanges • Violating applicable laws Upon termination, your right to use the Platform immediately ceases.
The Platform and all content, features, and functionality (including but not limited to all information, software, text, displays, images, video and audio) are owned by 29 Travel Club, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, transmit, display, or perform any content from the Platform without the express written permission of 29 Travel Club.
Your use of the Platform is also governed by our Privacy Policy. Please review our Privacy Policy to understand our practices regarding the collection and use of your personal information.
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL 29 TRAVEL CLUB, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF 29 TRAVEL CLUB HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM: • Your use of or inability to use the Platform • Any unauthorized access to or alteration of your transmissions or data • Any third-party conduct on the Platform • Any home exchange or interaction between members
You agree to indemnify, defend, and hold harmless 29 Travel Club and its officers, directors, employees, agents, and successors from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from: • Your use of the Platform • Your violation of these Terms of Service • Your violation of any applicable law or regulation • Your User Content • Your home exchange activities • Your infringement of any intellectual property rights
If any provision of these Terms of Service is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect, and the invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.
These Terms of Service, together with our Privacy Policy and any other policies posted on the Platform, constitute the entire agreement between you and 29 Travel Club regarding your use of the Platform and supersede all prior and contemporaneous agreements, whether written or oral.
